Welcome to Koda! These Terms of Service ("Terms") govern your access to and use of the Koda mobile application ("App", "Service", or "Koda") provided by Wizeyes ("we", "us", or "our"). By downloading, accessing, or using Koda, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
Koda is a health tracking application that helps you manage medical records, biomarkers, blood work results, and health events. The App provides:
Koda uses Sign in with Apple for authentication. By signing in, you agree to provide accurate information and maintain the security of your Apple ID credentials.
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. Please notify us immediately of any unauthorized use of your account.
Koda offers a subscription service managed entirely through Apple's App Store.
All subscription purchases are processed through the Apple App Store and are subject to Apple's refund policies. We cannot process refunds directly. To request a refund, please contact Apple Support.
By using Koda's AI features, you acknowledge and agree that:

Koda is designed to help you track and organize your health information. The App and any AI-generated insights are for informational and educational purposes only. They are not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Koda and all its contents, features, and functionality (including but not limited to all information, software, text, displays, images, and design) are owned by Wizeyes and are protected by copyright, trademark, and other intellectual property laws.
You own all the health data you enter into Koda.

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZEYES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
KODA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT KODA WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We reserve the right to suspend or terminate your access to Koda at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
You may stop using Koda at any time by:
Upon termination, you will retain access to your locally stored data, but will lose access to premium features.
We may update these Terms from time to time to reflect changes in our practices, technology, legal requirements, or other factors. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of Koda after changes are posted constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wizeyes operates, without regard to its conflict of law provisions.
